Drivers are not the only individuals in the transport chain responsible for safety and potential breaches of the law. The chain of responsibility means that anybody who has control in a transport operation can be held responsible for breaches of road laws and may be made legally liable.

If you are involved in any of the following road transport activities you may be held responsible for breaches of road laws:
  • Consigning – a person or company commissioning the carrying of goods
  • Packing – placing goods in packages, containers or pallets
  • Loading – placing or restraining the load on a vehicle
  • Driving – the physical act of driving a heavy vehicle
  • Operating – operating a business which controls the use of a heavy vehicle
  • Receiving – paying for the goods/taking possession of the load
Anyone who victimises an employee or contractor who raises concerns about actual or possible breaches of road transport laws, has committed an offence.

If you are being forced to drive long hours or given unreasonable schedules you can contact Eugene Richards from the Union office on 1300 727 614 or VicRoads on 13 11 71.
