WorkcoverWhile health and safety in the workplace can be managed with commitment, consultation, training and co-operation, accidents do happen and workers do get injured.
Where a worker is injured in the workplace, they may be entitled to compensation and/or to sue the employer or a third party for Common Law damages. This may be the case whether you are a part-time worker, casual worker or sub-contractor (such as an owner driver).
You may be entitled to compensation for the aggravation, acceleration, exacerbation, deterioration or recurrence of your injury if you can show a relationship between your employment and the injury. You may be entitled to claim compensation for weekly payments, a lump sum and/or to sue your employer or a third party for their negligence for your pain and suffering and your loss of earnings.
WorkCover issues (e.g. what your entitlement to weekly payments might be) can be very complicated and confusing.
